“The writ of habeas corpus is a high prerogative writ, known to the common law, the great object of which is the liberation of those who may be imprisoned without sufficient cause. Ex Parte Watkins, 28 U.S. 193, 202 (1830) Chief Justice Marshall.

The court should have ordered the response. The court rules are inconsistent with federal law 28 U.S.C. 2243.  vioilating (the word court refers to the district court)

When I prepare a writ I have 5 numbered full pages. Getting other documents notarized the I notice something odd about the 5th page. There was extra pace. But it did not click.

 

Once the writ was docketed in SCOTUS, I saw the errors. No constitutional provisions and the date was incorrect. I do remember that twice a pop up appeared asking if I wanted to continue to share documents. I said no. WTF

But the most important part is the questioned presented

2255 Motions to Vacate Convictions Cases

 

In dismissing these 2255 motions to vacate, the government lawyers and judges failed to respond  to the allegation of ground one which are the same in all § 2255 motion applications. Rule (5)(b).

 

Ground One:

[Inmate]is being illegally deprived of a substantial constitutional right, his liberty. Congress criminalized marijuana without compelling government reasons therefore without due process of law contravening the 4th and 5th Amendments of the Constitution of the United States and is unconstitutional.”

 

The courts have denied the being incarcerated is seizure of person and  deprivation of their constitutional right of liberty.
