The Lies of the Drug War

There would be no Drug War if there was equal protection of law, of fundamental rights of defendants. Being arrested or summoned to court is seizure of person and  deprivation of liberty. The rule of law requires deprivation of a fundamental rights  must be justified by a compelling state interest, the reasons for the law.

The Drug War over cocaine heroin, and marijuana, is maintained by a lying legal system that continues to make addiction a victimless crime. It has created and maintains the drug cartels in South and Central America, Mexico  and into the United States and from the rest of the drug opium producing world.

 

State police power is reasonable to deprive your liberty when you pose a substantial threat to the rights of other, a threat to public health and safety.

 

Drug user do not always pose a threat to the rights of other. Beaware that stealing is a non violent and has a victim.

 

It is a lie that police power can be used to protect persons from themselves. by exercising their right to acquire, possess and use their property. It is only when persons injure the right of others, public safety that state police power can be use to protect by reasonable regulations.

 

Drug cartels destabilize democratic governments.

 

It is a lie that the Fourth Amendment applies only to the operation of penal laws and not to the reasons for the laws.

 

It is a lie that due process of law refers to only procedural due process and not substantive due process of law determining the substance not of liberty but the substance, the reasons for the law that authorizes the use of police power to deprive liberty, property of violators.

 

It is lie that America is the leader of the free world when tens of millions have been deprived of liberty and property for political reasons.

 

It is a lie that judicial standard review of laws that authorize that use police power is rational basis standard of review not strict scrutiny

 

It is a lie for the courts to declare I am claiming marijuana is a fundamental right.

 

It is a lie for the courts to declare one has to be prosecuted to question the constitutionality of a law that threatens to deprive liberty and property.

 

It is a lie for the courts to declare penal laws are a political question.

 

It is a lie that police can arbitrary enforce penal laws.

 

It is a lie the use of police power is a political question’

 

It is a lie for the judiciary to declare police power in the enforcement of the marijuana a laws does not deprive fundamental right to liberty, property, the right to be secure against unreasonable searches and seizures

 

It is a lie that drug users are non-persons  and not entitled to equal protection of law, the Fourth and Fourteenth Amendments.
